OR - ASML verzoekt uitstel verkiezingen

De dagelijkse praktijk doet weer zijn intrede, althans zoveel mogelijk.
ASML doet er alles aan om op een verantwoorde wijze het werk op de campus weer te hervatten. Hoe de periode die voor ons ligt eruit gaat zien is voor velen nog koffiedik kijken, maar een aantal zaken gaan wellicht al zeer snel een belangrijke rol opeisen van iedereen die bij ASML werkt. Immers jullie arbeidsvoorwaarden komen, als ASML dispensatie krijgt van de Raad Overleg Metaal, ter sprake en dan is het zaak daarop goed voorbereid te zijn. 

De medezeggenschap
De OR heeft volgens de wet op ondernemingsraden een stimulerende taak als het gaat om de cao. De OR is niet de partij die een cao afsluit. De OR moet bevorderen dat de ondernemer de cao-afspraken naleeft. Het is daarom zaak dat de OR hier goed op voorbereid is en slim te werk gaat. Zo’n ondernemingsraad houdt steeds haar doel voor ogen en dat is: de werknemersbelangen vertegenwoordigen bij belangrijke besluitvorming in de onderneming. 

OR wil uitstel verkiezingen
De zittingstermijn van de huidige ondernemingsraad loopt af in oktober dit jaar. Er zijn dus verkiezingen in aantocht! Echter is de huidige OR een andere mening toegedaan. Zij willen de huidige zittingstermijn verlengen en verkiezingen dus uitstellen tot volgend jaar! Dat heeft de OR de vakbonden in een conference call en via een formeel schrijven laten weten. Maar waarom? Dat is ons niet helemaal duidelijk. Wij zien die gegronde reden niet. Wij gaan dus ook niet akkoord. Er is geen wettelijke basis waaruit blijkt dat dit gerechtvaardigd is. Dus gaan we ons opmaken voor OR verkiezingen
Meedenken, meepraten en meebeslissen door medewerkers is nodig. Een organisatie kan niet zonder goede medezeggenschap. Daarom zijn wij op zoek naar geschikte kandidaten voor de ondernemingsraad ASML.

Eenmaal gekozen kun je als OR-lid op onze steun rekenen. We beantwoorden jouw vragen, bieden ondersteuning bij trajecten en voorzien je van informatie en advies. Ook organiseren wij jaarlijks een interessant platform en masterclasses voor beginnende OR-leden. En werk je samen met de kaderleden van de vakbond op bedrijfsniveau. Zodra de datum voor verkiezingen bekend is ontvang je de benodigde info hierover.

Works Council ASML seeks postponement of elections:

Dear people,

The Netherlands is gradually crawling out of lockdown, with rules being eased cautiously, and processes restarted where possible, although with due observance of the precautionary measures imposed by the Dutch National Institute for Public Health and the Environment [Rijksinstituut Voor Volksgezondheid en Milieu, abbreviated to RIVM]. Daily activities have been resumed as far as possible. ASML is doing its utmost to resume work operations on the campus in a responsible manner. However, what the period ahead will look like seems, for many, to involve gazing into a crystal ball, but it is clear that several matters are likely to play a major role for the ASML workforce as a whole. After all, if ASML is granted dispensation by the Raad van Overleg in de Metalektro (abbreviated to ROM - the consultative council for the metal-electro industry in which employers and employees are represented), your employment conditions will be tabled for discussion, an event for which we need to be thoroughly prepared. 

Co-determination
According to the Dutch Works Councils Act [Wet op de Ondernemingsraden, abbreviated to WOR], a works council has a stimulating task when it comes to the collective labour agreement (CAO), but it is not the party that concludes one. The works council needs to ensure that the employer complies with the terms and agreements laid down in the collective labour agreement. Therefore, it is important for the works council to be well prepared and to act in a professional manner. The works council remains focused on its ultimate objective: promoting employees' interests during major decision-making processes within the company. 

Works Council seeks postponement of elections
The term of office of the incumbent Works Council expires in October 2020, meaning that elections are just around the corner. However, the Works Council is of a different opinion, and wants to extend its current term of office by postponing the elections until next year. As regards this matter, it has notified the trade unions during a conference call and by way of an official letter. However, the reason is not quite clear to us. We see no valid reason for postponement, and therefore we will not endorse it. Moreover, there is no legal basis indicating that a postponement is justified. Preparing for Works Council elections
It is necessary for employees to contribute ideas, join the discussions, and take part in the decision-making process. An organisation cannot function efficiently without adequate co-determination, and therefore we are looking for suitable candidates for the ASML Works Council. Of course, once you have been elected you can count on our support. We will answer your questions, provide support during processes, and provide you with information and advice. Furthermore, every year we also organise an interesting platform and masterclasses for novice works council members, and you will work together with active trade unionists [kaderleden] at the company level. You will receive more information as soon as the election date is known.
